H.P.P KENNELS CONTRACT TERMS:
HEALTH WARRANTY & GUARANTEE
(a) Ownership & Title:
Seller is the lawful owner of the Dog with full authority to sell. The Dog is sold free of any lien or encumbrance.
(b) Purebred Status:
Seller guarantees the Dog is purebred and offspring of the represented sire and dam. No guarantees are made regarding size, color, coat, show quality, or breeding ability. Buyer acknowledges independent research of the breed.
(c) Transport:
If Buyer chooses transport, Seller is not responsible for illness or disease exposure during transit. Transport liability rests solely with the transporter.
10-Day Health Examination
The buyer must have the Dog examined by a licensed veterinarian within 10 business days of purchase.
If deemed unfit for sale at time of purchase:
Sellers must be notified within 24 hours.
A written veterinary report must clearly describe the Dog, diagnosis, and state the condition existed prior to sale.
The vet must send documentation directly to Seller.
Buyer’s sole remedy is return of the Dog for:
A replacement from a current/upcoming litter, or
A refund (at Seller’s discretion).
Failure to obtain an exam, provide documentation, or return the Dog voids this warranty.
All medical and transportation costs are Buyer’s responsibility.
Dogs may not be euthanized without prior communication with the seller.
Death Within 10 Days
If death occurs within 10 days, Buyer must notify Seller within 24 hours and provide a signed veterinary report (sent directly to Seller) stating cause of death and confirmation the condition existed prior to sale.
Exclusions
This guarantee does NOT cover:
Hypoglycemia, cherry eye, entropion/ectropion, allergies, undescended testicles, luxating patella, elongated soft palate, umbilical hernia, dermatitis, demodectic mange, kennel cough, parasites (internal/external), coccidia, heat stroke, abuse, neglect, improper socialization, or environmental injury.
The buyer is fully responsible for the Dog’s care, environment, and all medical costs.
This guarantee applies only to the original Buyer and is non-transferable.
One-Year Congenital / Hereditary Guarantee
Seller guarantees the Dog against life-threatening congenital or hereditary defects for 1 year from date of birth.
If diagnosed:
Sellers must be notified within 5 business days.
Conditions must be confirmed in writing by two licensed DVMs.
Laboratory verification must be performed by a licensed DVM.
Remedy: credit toward a replacement puppy from the next available litter.
No monetary refund under this section.
Replacement must occur within 1 year of contract date.
Lifetime Return
If Buyer cannot keep the Dog at any time, Dog must be returned to Seller.
Dogs may not be surrendered to a shelter or third party without Seller’s consent.
Refund or replacement is at Seller’s sole discretion.
BILL OF SALE / NON-BREEDING
Upon full payment, Seller will transfer ownership and registration (if applicable).
Unless otherwise stated in writing, Dog is sold on a non-breeding agreement.
If bred:
First occurrence: Buyer forfeits all puppies, pays $5,000 in damages, plus attorney/court fees.
Second occurrence: Ownership reverts to Seller.
FITNESS FOR PURPOSE
Seller makes no guarantee regarding suitability for show, performance, obedience, or breeding. The buyer assumes responsibility for development and training.
NON-DISPARAGEMENT
Buyer agrees not to make or encourage false or defamatory statements damaging to Seller or Seller’s business, including on social media, review sites, blogs, or forums.
Violation constitutes material breach. Sellers may pursue damages, court costs, and attorney’s fees.
AGREEMENT & SIGNATURES
By signing below, the Buyer and Seller acknowledge that they have read, understood, and agreed to all terms and conditions outlined in this Purchase Contract. This document constitutes the entire agreement between the parties and supersedes any prior discussions or representations.
Buyer acknowledges that no verbal promises or guarantees have been made other than those expressly stated in this written agreement.
This agreement becomes legally binding upon signatures of both parties.
